Sun Pharma’s Legal Challenge

Sun Pharma Laboratories, a subsidiary of Sun Pharmaceutical Industries, has approached the Delhi High Court seeking permission to manufacture and market generic oral semaglutide tablets, challenging the scope of Novo Nordisk’s patent protection.

During the November 4 hearing, Sun Pharma argued that its proposed formulation falls outside the range covered by Novo Nordisk’s patent. The company submitted two test reports, including one from IIT, to support its position.

The court sought a response from Novo Nordisk and observed that manufacturers whose formulations fall outside the patented range should be allowed to manufacture oral semaglutide. The matter is scheduled for its next hearing on December 9, 2026.

The dispute centres on the formulation of oral semaglutide, sold by Novo Nordisk under the brand Rybelsus, used in the treatment of Type 2 diabetes. The outcome could influence generic competition in India’s growing diabetes drug market.
