India’s New E-Commerce Rules Could Create A New Startup Opportunity

India’s e-commerce market is entering a new phase as the government tightens rules around pricing, search results, sponsored listings and consumer protection.

 

The Department of Consumer Affairs has amended the Consumer Protection (E-Commerce) Rules, 2020, with the new framework set to come into force from January 1, 2027. The changes are designed to make online shopping more transparent while giving consumers greater protection against misleading practices.

 

But for India’s startup ecosystem, the regulatory shift could create a new category of opportunity: technology that helps e-commerce businesses stay compliant.

 

New Rules Could Create Demand For Compliance Tech

One of the biggest changes concerns pricing.

 

Whenever an online seller announces a price reduction, platforms will have to display both the reduced price and the prior price. The prior price will be defined as the lowest price at which the product was offered during the 30 days before the discount was announced.

 

This could create demand for software that automatically tracks historical prices, maintains audit trails and helps sellers verify whether their advertised discounts comply with the new rules.

 

For startups, that opens the door to tools focused on price monitoring, automated compliance checks and seller dashboards.

 

Search and Sponsored Listings Come Under Scrutiny

The amended rules also prohibit e-commerce platforms from manipulating search results in ways that mislead users or reduce the relevance of results to their searches.

 

Sponsored products and services will also need to be clearly and prominently identified.

This could create opportunities for startups developing technology around transparent search, ranking audits, sponsored-content disclosure and marketplace analytics.

 

Dark Patterns Become A Bigger Business Risk

E-commerce companies will also have to comply with the government’s 2023 guidelines on dark patterns.

 

Platforms must conduct a yearly self-audit and prominently display a certificate confirming compliance.

 

For startups, this could become another technology market.

 

Companies could build tools that scan websites and apps for potentially problematic user-interface practices, generate compliance reports and help businesses identify issues before they become regulatory problems.

 

Seller-Tech Could Become The Next Opportunity

The rules also expand the information marketplaces need to provide about sellers and products, including return and refund policies, warranties, delivery information, payment methods and country of origin.

 

That creates another potential market for startups building seller verification, product-information management and compliance automation platforms.

 

Marketplace platforms will also have restrictions around using consumer information for certain purposes without express and affirmative consent. In addition, bundled fees for services unrelated to the e-commerce platform will generally not be allowed, subject to an exception for loyalty or membership programmes.

 

The Startup Opportunity

India’s e-commerce regulations are becoming more detailed as online shopping becomes a larger part of consumer spending.

 

For startups, the opportunity may not simply be to build another marketplace. It could be to build the infrastructure that helps thousands of marketplaces, brands and sellers operate within the new rules.

 

From automated price audits and dark-pattern detection to seller verification and regulatory dashboards, compliance itself could become a new software category in India’s digital commerce ecosystem.

 

With the rules coming into effect in January 2027, startups that begin building these solutions early could find themselves serving a growing need across India’s e-commerce industry.
